BrighterSite Terms of Service
This document sets forth the agreed-upon business arrangement between the purchasing or participating client (the "user") and BrighterSite.
By using the site or any of its tools or information, you agree to the following terms of service.
The essences of this agreement states that:
- BrighterSite will provide the user with the stated set of services on this site. BrighterSite is responsible for reliably and consistently providing the services without interruption, and at a high quality. BrighterSite will treat all client data with the highest levels of security and respect.
- In return, the user will pay the required fees. The user will not abuse
or misuse the service. The user will not hold BrighterSite
liable
for the user's resulting business performance from use of BrighterSite
services, and uses them at their own risk.
Use of user and user’s client data
All user and user data is kept absolutely secure and private.
Please read our PRIVACY POLICY to learn how carefully
and respectfully we handle client data.
User's business performance is not BrighterSite’s
responsibility
The user’s business performance is not the responsibility
of BrighterSite. Users and any other users of this site use it,
the tools, and the information at their own risk. Users will
not hold BrighterSite responsible for any lack of business performance,
loss of clients, loss of revenue or capital, loss of opportunity,
or any other business impact resulting from or from not using
BrighterSite products, services, and information.
Length of engagement
A license for BrighterSite currently lasts for one year or on
month, depending on the product purchased, and it starts
on the day of purchase.
BrighterSite’s right to changes, improvement, or reduction in services
BrighterSite holds the right to alter its services at any time.
This may include adding new features, removing features, or
changing “free” features to “pay” features.
Users under a paid service contract will always continue to
receive
the same or better level of service throughout the entire term
of their contract.
Changes in pricing
BrighterSite holds the right to raise or lower prices at will.
This may include adding new features, removing features, or
changing “free” features to “pay” features.
Users under a paid service contract will maintain the pricing
arrangement
they agreed to at point of purchase. They will not
be charged more during their service term in the event of a price
increase, nor will they receive a credit or partial refund in
the event of a price decrease.
User mis-use of services
Users agree to not mis-use or mis-represent BrighterSite’s
services in any shape or form, or use the services in a fashion
they were not intended to be used, namely any use that does not
support managing and growing their businesses through referrals
from existing contacts. This includes using BrighterSite software or servers
for unsolicited e-mail
campaigns (i.e., spam), sending incomplete or altered
BrighterSite content, re-publishing or distributing content on
other websites, using BrighterSite to impersonate another person,
or using BrighterSite to support illegal activities.
Refusal or discontinuation service
BrighterSite reserves the right to refuse or discontinue service
to any user that BrighterSite feels is abusing or misusing
BrighterSite services, or mis-representing their usage of the
site.
Re-publication or distribution of BrighterSite materials
With the exception of publishing their BrighterSite e-cards and
referral forms, users may not redistribute or re-publish
content from BrighterSite
without the express, written permission of BrighterSite.
3rd parties and non-BrighterSite entities on the site
Some of the content, links and tools on or linked to on BrighterSite
are managed by 3rd parties and other partnered companies. BrighterSite
does not govern or manage the content, products, promises,
or other claims made by these 3rd parties and cannot be held
responsible for their accuracy, consistency, or business practices
of these companies. Users agree to interact with these parties
at their own risk.
BrighterSite's indemnity
- BrighterSite is not responsible in any way for the success
of your business, nor any damages, losses, lost business, lost
jobs, or other effects that could possibly be tied to the usage
of our products.
- BrighterSite makes no specific recommendations
for any specific company or situation, and are not responsible
for any individual's, group's, or company's business decisions.
- All content on BrighterSite is original and authored by BrighterSite
practitioners. Any similarity to other licensed or copyrighted
content is purely coincidental.
- Overall (as in business) users use BrighterSite products at
their own risk.
